Fairverra Terms of Service

Version 1.4 — effective 2026-10-19. The current Terms, Privacy Policy and Domain Registration Agreement must be accepted before a production deposit and before a paid order placed with an API key or an OAuth token. POST /v1/me/acceptances records that acceptance. A portal checkout is not that gate.

1. Who we are and what this covers

Fairverra (operated by Nuevo Comienzo BV, the Netherlands) provides domain name registration, transfer, renewal, restore, DNS and related services through a REST API and web portal ("the Service"). These terms govern every account that uses the Service. By accepting them (through the API or the portal) you enter into an agreement with Fairverra.

The agreement is between you and Fairverra. Fairverra acts in its own name. A domain is sponsored by a registrar. That registrar may change, and these terms do not name one. Fairverra is not an ICANN-accredited registrar. On request we identify the registrar that sponsors a domain on the account at that time. You can also look up a gTLD registrar via ICANN Lookup. Domain registrations are subject to the policies of the registry for that TLD and, for gTLDs, to the ICANN policies that apply to that domain.

2. Your account and API keys

You must provide accurate account details: your legal name, address, and — for businesses — company name and VAT number where applicable. You keep these up to date via the API (PUT /v1/me/billing) or the portal. Invoices are issued to these details.

API keys are shown once at creation and act on your account with the scopes they carry. You are responsible for every action performed with your keys, including by tools or AI agents you authorise. An authorized key binds the account. There is no extra human approval after that. Confirming a quote is the confirmation of that order. Keep keys secret; revoke a key immediately if you suspect compromise. Fairverra may suspend keys or accounts on reasonable suspicion of abuse or fraud.

Acceptance of a legal document is logged on the account: the document, the version, the time, the auth type, and for a key the prefix and key id. The log does not store the key secret.

Fairverra may set, change, or remove a daily spend cap in EUR on the account (spend_cap_daily_eur). The cap that applies is the one on the account when the order is confirmed. It limits that UTC day, separate from the wallet balance, and it is per account, not per key. If the account has no cap, there is no daily limit. You do not set this cap.

3. Prepaid wallet and payment

The Service is prepaid: you fund a wallet by deposit. The wallet is in EUR. Paid actions (registrations, transfers, renewals, restores) are charged to that wallet at the moment you confirm a quote. Quotes show the exact EUR price before you confirm, including VAT where VAT applies. Catalog and check prices are in EUR excluding VAT unless stated otherwise. A confirmed order is a binding purchase of the EUR total on that quote.

We may also show an amount in another currency, such as USD. That figure is a display label (presentment). It is not a second wallet, not a USD charge, and not an offer to settle in dollars. Confirming a quote always debits the EUR total. A presentment label can move with the exchange rate; only the confirmed EUR total is the price you pay.

If an action fails definitively at the registry after payment, the amount is automatically credited back to your wallet. Wallet balances carry no interest. Ending the account does not by itself oblige Fairverra to refund the remaining balance.

Fairverra sets the EUR price. We may change it at any time, including when the registrar's price and the registry fee have not changed. We do not announce price changes, and we do not need a reason you can rely on. A figure in an email, including a renewal notice, is a price at the moment of sending. It is not an offer, and no rights can be derived from it. A quote is valid for 24 hours. Only the EUR total on a quote you confirm before it expires is the price you pay.

Premium domains have non-uniform pricing: the registration and renewal fee for a premium name may differ substantially from the standard fee for that TLD, and is shown in the quote.

4. Domain registrations

Domains are registered on a first-come, first-served basis. Fairverra and its registrar act as intermediaries between you and the relevant registry; neither can guarantee the continuity or existence of any registered domain, since third-party rights (such as trademarks) may be involved. You are solely responsible for the choice of a domain name and for verifying that it does not infringe third-party rights.

Every registration is subject to the policies of the relevant registry and, for gTLDs, ICANN policies — including the Uniform Domain-Name Dispute-Resolution Policy (UDRP), the Uniform Rapid Suspension procedure (URS) and the Transfer Dispute Resolution Policy. You must comply with a formal decision about a domain name, such as a WIPO panel decision or a court order.

You must provide accurate and complete registrant (WHOIS/RDAP) contact data and keep it current. Changes to the domain holder's details must be notified to us immediately, and in any event within five calendar days. Wilfully inaccurate contact data is ground for suspension or cancellation of the registration. You indemnify Fairverra against claims arising from your choice or use of a domain name.

Where a policy requires approval of a transfer or a change of registrant, you authorize Fairverra, and through Fairverra the registrar, to submit that approval for domains on the account. This authorization does not remove a transfer lock, and it does not override a lock, a dispute, or a registry rule. If the registrant is your customer, you give that authorization for them and you are responsible for having their permission. Fairverra does not contract with your customer. You also accept the pass-through obligations in section 7.

5. Expiry, deletion and restore

A domain that is not renewed before its expiry date follows that registry's process. Periods, fees and whether a restore is still possible differ per TLD. We do not promise a fixed number of recovery days. A restore quote shows the fee before you confirm. If the registry refuses the restore, a confirmed failure is credited back to the wallet as section 3 describes. It is your responsibility to renew in time. You can always choose not to renew.

Expiry and renewal notices may come from Fairverra or from another party, including the registrar, the registry, or a partner. Fairverra may email the account about renewal and expiry of the domains on the account. You can turn that account mail off with status_email. Turning it off does not stop a notice sent by someone else. A price in a Fairverra mail is a price at the moment of sending. It can change, and no rights can be derived from it. If a Fairverra mail does not arrive, that is not a claim, and it does not move your duty to watch the expiry date.

Auto-renew is off unless you turn it on for that domain. If it is on, the renewal runs at the EUR price Fairverra charges at the moment it runs. We do not ask you to accept a new price first. The charge goes to the wallet, or to the saved card when the account has a recurring mandate for auto-renew. You can turn auto-renew off before it runs. Turning it off, or not ordering a renewal, is how you decline.

6. Transfers and auth codes

Outgoing transfers follow the applicable ICANN, registry and registrar policy. We do not promise that every domain can leave at any moment. Where the TLD uses an authorization code, you can retrieve it. Where the TLD supports a registrar lock, you can unlock. We do both within five calendar days of the request where those mechanisms exist. Some TLDs have neither. A dispute or a registry rule can still block the transfer.

7. If you resell to your own customers

If you use the Service to provide domains to your own customers, you additionally agree that you:

  • act towards your customers in your own name, at your own expense and risk;
  • impose obligations on your customers equivalent to sections 4, 5 and 6 of these terms (registry and ICANN policies, accurate contact data, dispute policies);
  • keep a registration agreement per domain (domain name, holder, order date) and retain it until at least two years after your customer contract ends — we or the registrar may request a copy;
  • inform your customers about the deletion and auto-renewal policy (section 5);
  • identify the registrar when a domain holder asks, and do not present yourself as ICANN-accredited;
  • provide auth codes and unlocks to your customers within five calendar days where the TLD uses those mechanisms;
  • publish links to ICANN's Registrants' Benefits and Responsibilities and Registrant Rights and Responsibilities;
  • remain liable to Fairverra even if your own customers do not pay you — non-payment downstream does not discharge your prepaid wallet or other payment obligations;
  • accept that Fairverra or the registrar may contact your customers directly when required by ICANN, registry policy, a court order, or an urgent abuse case.

8. Acceptable use and suspension

You may not use the Service for unlawful activity, including phishing, malware distribution, spam, trademark abuse or fraud. We may immediately suspend or terminate domains, keys or accounts, without warning you first, including where these terms, registry policies or the law are violated, and including on an abuse report, a court order, or a dispute decision.

9. Availability and liability

We aim for high availability but the Service is provided without an uptime guarantee unless agreed separately in writing. Registries, the registrar and payment providers are third parties whose availability we do not control.

Fairverra is not liable for damage arising from the Service, including indirect damage (lost profit, lost data, business interruption) and force majeure, including failures at registries, the registrar or payment providers. Nothing in these terms excludes liability that Dutch law does not allow us to exclude, including liability for intent or gross negligence, and rights that mandatory consumer law gives you.

10. Data and privacy

We process account and registrant data to provide the Service. Registrant contact data is shared with the registrar and the relevant registry as required for registration, and may be published in WHOIS/RDAP according to registry policy. The Privacy Policy describes that processing. Where you resell to your own customers, you are responsible for your own legal basis for passing their data to us.

11. Changes, duration and termination

We may amend these terms on their own. The Privacy Policy and the Domain Registration Agreement can each change without the others. A new version of any of them must be accepted before the next production deposit and before the next paid order placed with an API key or an OAuth token. Continued use alone does not replace that acceptance.

The agreement runs indefinitely. You may stop using the account. We may end the account at any time. Domains remain registered until expiry or until they are transferred under section 6.

12. Applicable law

Dutch law applies. Disputes are submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
